Pari-mutuel Terms and Conditions

1. Introduction

Welcome to Pari-mutuel. These Terms and Conditions ("Terms") govern your access to and use of the Pari-mutuel mobile application and website ("Service"). The Service is operated by FIQIXIT ("we", "us", or "our").

Pari-mutuel operates a pari-mutuel betting system exclusively for selected football matches. Our Service is available only to users residing in Kenya who are at least 18 years of age.

2. Account Creation and Eligibility

• You must be at least 18 years old to create an account and use the Service.
• You must provide accurate and complete information during the registration process, including a valid Kenyan phone number.
• You are responsible for maintaining the confidentiality of your account details and password.
• Each user is allowed only one account. Duplicate accounts may be terminated without notice.
• Your account status will be 'INACTIVE' upon registration. To place bets and receive payouts, you must activate your account.

3. The Pari-Mutuel Betting System Explained

Pari-mutuel operates on a pari-mutuel (or totalisator) system, meaning all bets on a specific game are placed together in a common pool. The payouts are then calculated based on the total amount in the pool after deductions, and divided among the winning bettors.

• Pooled Bets: All money bet on a specific outcome for a given game contribute to a single prize pool.
• Fixed Bet Amount: To ensure fairness and simplify the pool, all users place bets of similar, predetermined amounts on the same game. The specific bet amount will be displayed for each game.
• Limited Games: Typically, there will be approximately five (5) football games available for betting each day.

4. Placing Bets

• Bets can only be placed on the designated football matches available on the Service.
• Once a bet is confirmed, it cannot be cancelled or altered after the match has started.
• All bets must be placed before the start time of the match. Bets placed after the start time will be voided, and the bet amount refunded to your wallet.
• We reserve the right to refuse or limit any bet at our sole discretion.

5. Winnings, Payouts, Taxes, and Fees

5.1. Winnings Calculation:

Winnings in a pari-mutuel system are dynamic. The payout for a winning bet is calculated as follows:

1. Total Pool: All money bet on a specific game.
2. Deductions:
   • Service Fee: A fixed percentage (10%) will be deducted from the total pool as our service fee.
   • Applicable Taxes: A government-mandated 5% tax will be deducted on every deposit into your Pari-mutuel account.
3. Net Pool for Winners: The remaining amount after service fees and taxes are deducted.
4. Payout Per Winner: The Net Pool for Winners is divided proportionally among all winning bets for that specific outcome. Your payout depends on the number of other winners and the total net pool.

Example (Illustrative only): If the total pool is KSH 10,000, and our service fee is 10% (KSH 1,000), the net pool for winners is KSH 9,000. If there are 5 winning bets, each winner would receive KSH 1,800, regardless of their individual bet amount (since all bet amounts are similar).

5.2. Payouts:

• Winnings will be credited to your Pari-mutuel wallet balance shortly after the official result of the match is confirmed.
• Withdrawals can be initiated from your wallet to your registered M-Pesa phone number, subject to minimum withdrawal limits and processing times.

6. Deposits and Withdrawals

• All transactions (deposits and withdrawals) will be processed via M-Pesa.
• Minimum and maximum transaction limits may apply.
• You are solely responsible for ensuring the accuracy of your M-Pesa details for transactions.

7. Responsible Gaming

Pari-mutuel promotes responsible gaming. Betting should be an enjoyable activity, not a necessity. If you feel you may have a gambling problem, please seek help from relevant support organizations.

• We may provide tools to help you manage your betting, such as deposit limits.

8. Intellectual Property

All content, trademarks, logos, and intellectual property on the Pari-mutuel Service are owned by FIQIXIT or its licensors. You may not use any of these without our express written permission.

9. Limitation of Liability

To the fullest extent permitted by law, Pari-mutuel shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use or alteration of your transmissions or content.

10. Indemnification

You agree to indemnify and hold harmless Pari-mutuel, its affiliates, officers, agents, and employees from and against any claim, suit, or action arising from or related to your use of the Service or violation of these Terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs, and attorneys' fees.

11. Amendments to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Kenya.
